- Make sure the person you are talking to is an attorney, ask for their State Bar Number.
- Make sure the attorney you are talking to is a Tax Attorney; Tax Attorneys have two separate law degrees, a standard J.D., and a Specialized LLM in Taxation.
- Don’t listen to bunk about special IRS programs, like “Pennies on the Dollar.”
- Ask them about their experience, a charlatan with not have time to speak with you candidly.
- Stay away from 800 numbers, go local.
- Ask what they will do for you, a sign that something is wrong is just hearing “Don’t worry, everything is fine.”
- Ask them what sort of defenses you may have, a real Tax Attorney with be able to discuss this with you.
- Ask for a description of the IRS Controversy process.
- Ask them if bankruptcy is an option. Charlatans will not know the criteria for tax bankruptcy.
- Get a retainer agreement.
